Discussion

Allred, et al v. Pulte Homes, et al The case arose out of claims by multiple plaintiffs within 160 houses located in Banning, CA alleging water intrusion at the roofing systems. Gray•Duffy represented the excess carrier for the roofing subcontractor and intervened in the action on its behalf. The developer allocated 70 residences to the roofing subcontractor and made an initial settlement demand of $760,000 to the firm’s client. During settlement discussions, Gray•Duffy was able to establish that the exposure of the underlying roofing subcontractor was limited to 14 residences. The claims were then resolved for $11,500 and included a release of all issues including defense, indemnity and additional insured claims.
