Gray•Duffy Obtains Dismissal of Client in Construction Defect Lawsuit and Avoids Litigation

Michelle MacDonald of Gray•Duffy’s Encino office obtained a complete dismissal on behalf of the firm’s client avoiding a costly litigation.

Discussion

Haight v. Fred Guenther Construction This case involved the construction of a single-family home in Quartz Hill, California. Gray•Duffy’s client installed granite countertops in the kitchen and bathrooms of the home. In the complaint, the plaintiff asserted issues with the tile work, exterior drainage and buried weep screeds. The plaintiff then elaborated on installation problems with the tile in the baths, exterior balcony and throughout the residence. Prior to the need for litigation, the underlying complaint was mediated to a complete resolution. Although the first settlement demand was approximately $30,000, Gray•Duffy negotiated a dismissal in exchange for a waiver of costs and no appearance or settlement payment was necessary.
