Overview

David Fisher of Gray Duffy, LLP represented the defendants in these two separate but related cases filed in Santa Fe, NM in which Plaintiff was seeking damages arising out of our clients’ horse boarding contracts. Our clients alleged that they were induced to enter into stall purchase agreements under false pretenses.

Discussion

Plaintiff, Las Campanas Management, LLC sued our clients in the First Judicial District Court for the County of Santa Fe, New Mexico for breach of a written Promissory Note for the payment for the purchase of an Equestrian License for the use and ownership of a stall at the Las Campanas Equestrian Center. Our clients alleged that the director of the equestrian center told them prior to entering into the license agreement that the stalls were quickly selling out which would leave our clients without the ability to board their horses within their own equestrian community. Our clients later learned that the stalls within the equestrian center were subsequently being offered for lease to the general public free of any license fee. We filed an answer and cross-complaint against the Plaintiff in each case, moved to consolidate the two cases, and then engaged in settlement discussions which ultimately resulted in our client paying approximately half of the contract price in exchange for a dismissal of the action.
