Overview

Michael Eisenbaum of Gray Duffy’s Encino, CA office successfully defended a construction defect claim brought against the general contractor who constructed a single family residence. The claim was resolved for $1,000, in exchange for a full release and dismissal by the project developer and the homeowners.

Discussion

This case began as a claim by the developer for money owed for the construction project. The homeowners then cross-complained for construction defects and other claims against the developer, who then sought indemnity from the general contractor and architect. The parties exchanged discovery which revealed that the defect claims were fairly minor, and after extensive settlement discussions, a settlement was reach for $1,000 on behalf of the general contractor, who was then dismissed. The remainder of the case proceeded to trial, the outcome of which is still pending.
