John Duffy and Kevin Cruz of Gray•Duffy’s Encino office successfully negotiated a complete dismissal on behalf of the firm’s client, Thomas Drywall in a construction defect action filed by eight single-family homeowners in Santa Barbara.

Bojana Hill, et al. v. Storke Housing Investors, et al.

In 2009, eight single-family homeowners sued housing developer, Storke Housing Investors, LLC for numerous alleged construction defects in the homes.

The development corporation had been dissolved so the plaintiffs sued the firm’s client, Thomas Drywall, for the alleged defects. Gray•Duffy initiated an aggressive course of discovery including, multiple motions to compel, filed against the plaintiffs, who ultimately agreed not to pursue any claims against Thomas Drywall. The plaintiffs dismissed their case against the firm’s client without any settlement being offered or paid.
