The investigating police officer concluded that the plaintiff failed to notice the crane traveling at 30 miles per hour in front of him. The officer also concluded that the plaintiff was the sole cause of the accident by driving at an unsafe speed and was in violation of Vehicle Code section 22350. After Mr. Shorr served notice for the deposition of the plaintiff, his counsel agreed to dismiss the lawsuit for a waiver of costs.
