Patrick Roberts of Gray•Duffy’s Encino office successfully negotiated the resolution of substantial claims against the firm’s roofing subcontractor client in a construction defect lawsuit involving 26 residences located in San Clemente, California. The Plaintiffs originally alleged the total cost of repair was $218,452.04 for roofing related issues.

Discussion

Flynn Baglin, et al. v. Brookfield Homes, et al. The Developer’s initial demand to the firm’s client included an indemnity demand of $250,000 and a separate demand in the amount of $315,000, for a total settlement demand of $565,000. After substantial negotiations through several rounds of mediation, the case was ultimately settled for $10,000.
