Gray•Duffy obtains favorable settlement for plaintiff in bodily injury case

Attorney Nathan Lee of Gray•Duffy’s Encino office represented the Plaintiff in a bodily injury lawsuit against the owner of a Woodland Hills apartment complex and the City of Los Angeles.  

The Plaintiff was walking on the sidewalk in front of the apartment complex while wearing closed-toe, rubber-soled shoes. She sustained significant personal injuries when she rolled her right foot on a portion of the sidewalk that was displaced by five inches. Due to the accident, the Plaintiff sustained a severe fracture of her right foot, injuries to her ankle, and loss of blood flow. As a result, she was unable to operate her vehicle and she was forced to take medical leave from her employer for several months, resulting in the loss of considerable wages. Further, at the time of the accident, the Plaintiff did not have health insurance, and she had to pay cash for her related medical treatment.  

Gray•Duffy filed a lawsuit asserting that the Defendants failed to maintain the sidewalk and that the Defendants created a dangerous condition by not properly maintaining and/or repairing the sidewalk. In discovery, Gray•Duffy proved that the Defendants had actual knowledge of the sidewalk’s displacement at least five years prior to the Plaintiff’s accident, and that the Defendants failed to properly address the foreseeable risk. 

Gray•Duffy negotiated a favorable global settlement with the Defendants to cover the Plaintiff’s out-of-pocket expenses, pain and suffering, lost wages, lost future earning capacity, and future medical care.
