Gray•Duffy negotiates dismissal of defendant client in personal injury case

This litigation involved an accident that occurred in March 2017 at the Plaintiff’s home. Plaintiff alleged that while the Defendants were remodeling her house, she slipped and fell on the floor leveling compound, which had been placed on the floor of her home for the installation of new flooring material.
After issuing several demands to be dismissed, Gray•Duffy filed a Motion for Summary Judgment (MSJ) against the Plaintiff. The basis of the MSJ was that the Plaintiff failed to meet her burden as to duty, breach or causation, as the client did not perform any work at the home.
Just prior to the hearing on the MSJ, the Plaintiff filed a dismissal with prejudice and the court entered the dismissal accordingly.
