Highland Capital Corp. v. Medical Corp., Estate of Frank Ryan

The plaintiff, Highland Capital Corp., filed a lawsuit seeking a monetary award of $145,297.85 in past and future rent for three cosmetic and aesthetic laser machines. The plaintiff also sought interest, attorneys’ fees and costs in an unknown amount pursuant to the terms of the lease agreement.

The laser equipment was returned to the plaintiff who sold it for $62,392.50 reducing the amount of the claim to $82,905.35 plus interest, attorneys’ fees and costs. After requiring Highland Capital Corp. to provide supporting documentation reasonably demonstrating they obtained a fair amount in the sale of the equipment, Mr. Faucher negotiated a favorable settlement for $35,000 in mediation.
