Patrick Roberts of Gray•Duffy’s Encino office achieved a favorable settlement for a roofing subcontractor client in a large construction defect lawsuit.

Discussion

Quezada, et al v. Victoria Place, et al This case arose out of multiple claims from plaintiffs residing in 126 residences located in Calexico, CA. Gray•Duffy represented the excess carrier for the roofing subcontractor and intervened in the action on its behalf. The developer allocated 25 of the residences to the roofing subcontractor and made an initial settlement demand of $665,226.37 to the firm’s client. During settlement discussions, the firm was able to establish that the exposure of the underlying roofing subcontractor was limited, due to the roofing issues being substantially less significant than what was claimed. The lawsuit was resolved for $15,000 and of all of the issues, including defense, indemnity and additional insured claims were released.
