The Graves Amendment Defense for Renters of Motor Vehicles

In a “Deep Dive” article published on International Risk Management Institute’s website, Timothy Thornton and Kathryn Camerlengo discuss the Graves Amendment. This 2005 law abolishes vicarious liability of businesses as the owner of the motor vehicle. It applies to businesses that rent or lease motor vehicles, who are sued for the negligent driving of their renters. This is an important risk management consideration for businesses such as automobile rental companies and automobile lessors, and renters or lessors of trucks and trailers used in trucking and motor carrier businesses.
