Dismissal With Prejudice Obtained for Roofing Company in Wrongful Death Case

Attorney Stepan Naldzhyan obtained a dismissal with prejudice for our client, a father-and-son roofing company, in a wrongful death case arising from an accident at a luxury residential property in Laguna Beach, California. The plaintiff, who was the decedent’s mother, alleged liability after the decedent fell through a skylight while roofing work was being performed at the property.
Through investigation and extensive discovery, including several days of depositions of the decedent’s successor in interest, our client’s person most knowledgeable, and employees who were present at the construction site, Naldzhyan developed testimony and evidence establishing that our client had no liability for the incident and the plaintiff’s claim was barred from recovery. As a result, the plaintiff dismissed our client from the action with prejudice, and our client incurred no liability and made no payment to resolve the case.
