Dismissal Obtained for Physician in Medical Malpractice Case

GDEL’s client, a physician, was named as a defendant in a medical malpractice lawsuit in which the plaintiff asserted multiple causes of action, including medical malpractice, fraud, negligence and intentional infliction of emotional distress.

Through successive challenges to the legal sufficiency of the plaintiff’s pleadings, attorney Stepan Naldzhyan successfully demonstrated that the allegations failed to state viable causes of action against our client. Ultimately, the Court ordered a dismissal with prejudice of all claims against the physician, resolving the action in our client’s favor at the pleading stage and avoiding the need for continued litigation and trial.
