Gray•Duffy Prevails on Motion for Summary Judgment for Two Clients and Obtains Favorable Settlement for a Third Client

Overview

Wendy Lin Suh of Gray•Duffy’s Encino office obtained a summary judgment in favor of two clients in a personal injury lawsuit filed by the plaintiff injured on the defendant’s property, which was being leased by a construction company.  Gray•Duffy settled the case on behalf of the construction company for a fraction of the amount being claimed.

Discussion

Allen Peter Fagan v. Robert Buzek, et al. Gray•Duffy represented an independent contractor, a property owner and a construction company that  was leasing property in a personal injury lawsuit where the plaintiff sustained injuries to his right leg after being hit by a forklift driven by the independent contractor. The plaintiff’s statement of damages totaled nearly $136,000, consisting of past medical expenses, future medical expenses, and pain and suffering. Gray•Duffy prevailed on a motion for summary judgment against the plaintiff.  The court found that the property owners owed no duty to the plaintiff and Ms. Lin Suh negotiated a favorable settlement of $30,000 for the construction company.
