Ed Scott of Gray•Duffy’s Redwood City office defended Malone’s Painting & Deck Restoration in this single-family home construction defect case, and ultimately obtained a dismissal for the client.

Discussion

Cohen v. Terry L. Stigall, et al. In this construction defect lawsuit, several rounds of mediation took place. The matter involved numerous defendants and cross-defendants. Throughout the course of settlement negotiations, Mr. Scott aggressively asserted that the damage claimed by the homeowners was unrelated to the client’s work. Eventually, the matter settled for a total of $90,666. Of that amount, Malone’s Painting paid nothing and received a dismissal in exchange for a waiver of costs.
