Gray•Duffy, LLP Obtains Complete Dismissal for Crane Company Client in Serious Personal Injury Lawsuit

Matthew S. Shorr of Gray · Duffy’s Encino office defended Anglemyer Crane Rental arising from an August 11, 2012, incident at the LA Metro Station located on Hill Street between Temple and First Streets, in downtown Los Angeles. Paramount Metal & Supply and United Riggers were assembling a pedestrian canopy for the Metro station. Plaintiff suffered serious crush injuries when a portion of the canopy failed and collapsed onto the plaintiff after the crane was disconnected from the canopy by United Riggers’ crew.

Discussion

Old Republic Gen. Ins. Co. v. George Jue Manufacturing Co. Anglemyer Crane was hired to perform “hook work” for the purpose of setting steel for a pedestrian canopy at a LA Metro station. The plaintiff sustained serious injuries when the canopy failed and collapsed after the rigging crew attempted to adjust one or more leveling jacks which were supporting the canopy after the crane was disconnected from the load by the riggers. After the crane was disconnected from the load, it remained on the job site on “stand by” while other parties debated what adjustments should be made to the shoring system, since the canopy was visually out of level. The accident occurred immediately after adjustments were made by the riggers to the shoring system. After fact witness discovery was for the most part completed, Mr. Shore negotiated an agreement whereby Anglemyer Crane was dismissed from the lawsuit in exchange for a waiver of costs.
