So You Think You Know the Law…(Answers to the Spring Edition 2012 of Gray Matters)

May 2012

1. A public school is responsible for any injury sustained by a student while on a voluntary school sponsored and supervised field trip.. (True or False)

False: California Education Code § 35330 provides immunity to the school and its employees and volunteers. Cases have held that volunteer drivers are immune as are school employees as long as their conduct is not reckless or outside of the scope of their employment duties. Schools and districts are responsible under Education Code § 35331 to provide medical and hospital services to a student injured on a field trip.
