Gray•Duffy Negotiates Favorable Settlement for Auto Dealership in PAGA-Only Action

Erin Tenner recently assisted an auto dealership client in settling a PAGA-only action filed by technicians based on alleged failure to pay overtime, failure to pay timely wages, failure to indeminfy employees for tools and equipment, failure to properly reflect wages on the pay stub, failure to provide rest periods, failure to pay minimum wage, and failure to pay for meal periods. Plaintiffs alleged 35 currently employed employees were affected over 1610 pay periods. The PAGA action was settled covering 73 currently and previously employed employees for a total of $35.80 per pay period. We consider this an excellent result as average settlements range from $40 -$70 per pay period based on statistics provided by outside sources.
