A lot has been written about the Viking River Cruises case since it came down last month so a lengthy article is not warranted here. Suffice it to say that you need to make sure your arbitration agreement applies the Federal Arbitration Act and continue using it for the time being even with respect to PAGA cases. Make sure any attorney representing you in a PAGA case is not assuming that your arbitration agreement does not apply the Federal Arbitration Act even if it predated the Viking River Cruises case. This case may provide you with the means to move your PAGA case to arbitration, at least for the time being.
